Join insurance attorneys Ivo Labar, Dan Veroff and Demian Oksenendler for a discussion on hot issues and developments in insurance litigation, including, as time permits, recent decisional law on the Insurance Commissioner’s regulatory attempts to counteract California’s homeowner underinsurance crisis; actual cash value determinations in property claims; ERISA pre-emption in disability claims; concurrent litigation in state and federal court; the genuine dispute doctrine; policy rescission due to misrepresentations; the rise of “abuse and molestation” policies for nursing homes claims; the trouble with getting indemnity coverage in eviction cases against landlords; agent/broker mistakes in the world of automated underwriting; and more. The presenters will also encourage questions from non-insurance lawyers on how insurance affects their practice, including evaluating a bad faith claim, when to contact coverage counsel, and more.
